This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures to make the terms of this policy binding.

A. Acceptance of Terms

The terms and conditions set forth below (“Terms and Conditions”) and the Privacy Policy constitute a legally-binding agreement between QuestionCloud.in (“we”, “our” or “us”), and any user of this website including Service User (as defined hereunder) (“You” or “Your”). These Terms and Conditions contain provisions that define your limits, legal rights and obligations with respect to your use of and participation in
  • (i) the QuestionCloud.in website, including the classified advertisements, forums, various email functions and Internet links, and all content and QuestionCloud.in services available through the domain and sub-domains of QuestionCloud.in located at www.questioncloud.in (collectively referred to herein as the “Website”), and
  • (ii) the online transactions with respect to tests and study materials between those users of the website who are offering/selling/providing services (each, a “Service Professional”) and those users of the website who are obtaining/buying/using services (each, a “Service User”) through the Website (such services, collectively, the “Services”). The Terms and Conditions described below incorporate the Privacy Policy and apply to all users of the Website, including users who are also contributors of information, private and public messages, advertisements, and other materials or services on the website, but does not apply to the service professionals. The Website is currently owned and operated by QuestionCloud.in
You acknowledge that the website serves as a platform for agreeing upon Services between Service Professionals and Service Users, and, by using, visiting, registering for, and/or otherwise participating in this Website, including the Services presented, promoted, and displayed on the Website, and by clicking on “I have read and agree to the Terms and Conditions,” you hereby certify that:
  • 1. You are a Service User,
  • 2. You have the authority to enter into these Terms and Conditions,
  • 3. You are authorized to make payment for Services requested through the use of the Website, and
  • 4. you agree to be bound by all terms and conditions of these Terms and Conditions and any other documents incorporated by reference herein. If you do not so agree to the foregoing, you should not click to affirm your acceptance thereof, in which case you are prohibited from accessing or using the Website. If you do not agree to any of the provisions set forth in the Terms and Conditions, kindly discontinue viewing or participating in this Website immediately.

QuestionCloud.in reserves the right, in its sole discretion, to change, modify, or otherwise amend the Terms and Conditions, and any other documents incorporated by reference herein for complying with legal and regulatory framework and for other legitimate business purposes, at any time, and QuestionCloud.in will post notice of the changes and the amended Terms and Conditions at the domain of www.questioncloud.in. It is your responsibility to review the Terms and Conditions for any changes and you are encouraged to check the Terms and Conditions frequently. Your use of the Website following any amendment of the Terms and Conditions will signify your assent to and acceptance of any revised Terms and Conditions. If you do not agree to abide by these or any future Terms and Conditions, please do not use or access the Website.

B. Use of your Personal Information

We use the collected Information to analyse trends, to conduct research, to administer the Application/Services and products, to learn about each user's learning patterns and movements around the Application/Services and products and to gather demographic information and usage behaviour about our user base as a whole.
Aggregated and individual, anonymized and non-anonymized data may periodically be transmitted to external service providers to help us improve the Application, products and our Services.

We may at times provide aggregate statistics about our customers, traffic patterns, and related site information to reputable third parties, however this information when disclosed will be in an aggregate form and does not contain any of your Personally Identifiable Information.
Question Cloud will occasionally send email notices, messages or contact you to communicate about our Services, products and benefits, as they are considered an essential part of the Services/products you have chosen.

C. We may disclose Information

as required by law, such as to comply with a subpoena, or similar legal process;
to enforce applicable ToU, including investigation of potential violations thereof;
when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, address security or technical issues or respond to a government request;
with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Policy;
to protect against imminent harm to the rights, property or safety of the Application/Website/ Think and Learn Private Limited or its users or the public as required or permitted by law;
with third party service providers in order to personalize the Application/Website/Services/products for a better user experience and to perform behavioural analysis;
Any portion of the Information containing personal data relating to minors provided by you shall be deemed to be given with the consent of the minor's legal guardian. Such consent is deemed to be provided by your registration with us.

D. Access to your Personal Information

We will provide you with the means to ensure that your Personal Information is correct and current.
If you have filled out a user profile, we will provide an obvious way for you to access and change your profile from our Application/Services/Website/products.
We adopt reasonable security measures to protect your password from being exposed or disclosed to anyone.

E. Access to your Device

By Clicking Question Cloud’s Terms and Conditions Policy,
You are permitting Question Cloud to access your device’s camera, location and other applications only to give you a perfect user experience. Thus, collected information/ will only be used for the same purpose while your accession over Question Cloud’s Website/ Android or iOS Application(s).
You are permitting Question Cloud to send SMS, OTPs, reports/ results to your registered mobile number and to your email. This includes mails/ messages that will be sent to Question Cloud’s promotional purposes also.

F. Cookies

We send cookies (small files containing a string of characters) to your computer, thereby uniquely identifying your browser.
Cookies are used to track your preferences, help you login faster, and aggregated to determine user trends.
This data is used to improve our offerings, such as providing more content in areas of greater interest to a majority of users.
